Eliminating the 100 to 1Powder-Crack Cocaine Disparity by Karen Chung, Jan 26, 2009 (10:35pm)
Currently, possession of 500 grams of powder cocaine warrants a mandatory minimum sentence of five years. On the other hand, possession of 5 grams of crack cocaine warrants the same mandatory minimum sentence. Because the gross majority of crack cocaine offenders are black, the result of this sentencing disparity is massive racial discrimination. H.R. 265 (111th) would eliminate the 100 to 1 powder-crack cocaine disparity by increasing the amount of crack cocaine that is necessary to receive a mandatory minimum sentence. The bill would also provide additional resources to target cocaine kingpins while establishing a program to provide treatment and rehabilitation for substance abusers in prison.
