This act mandates that differences in pay must be based on a ‘bona fide factor other than sex’, and that these factors are job-related and consistent with business necessity. That this should be law is not even in question.

Some concerns arise over the nuances. The company in question is burdened with proving the above, and the act makes class-action suits easier to commence. Arguments against the act sometimes claim that such legislation will make employers less willing to hire people (of a given sex, race, etc.) who may someday bring suit… yet this is already itself illegal.

Any company who pays its employees fairly and equitably has nothing to lose, and much status to gain in the public’s eye.
