The root of the issue behind the State Secrets Protection Act (S. 417/H.R. 984) is trust: do Americans trust the President to determine what should be a state secret and what the public has a right to know? It becomes more important in court where evidence can be suppressed under the general excuse “it’s a state secret”. Exactly no one is denying there are circumstances when this is the case, but over the past eight years, the public has come to find that the “state secret” line was used not only when it was true, but when it was convenient.
